Guest Terms

These Guest Terms of Service (“Guest Terms”) constitute a legally binding agreement between you and Kvation, Inc. (“Kvation,” “we,” “us,” or “our”) governing your access to and use of the Kvation website (kvation.com) and related services as a guest, including any communication, booking, or stay facilitated through our platform (collectively, the “Services”).

By using the Services to search, book, or stay at a property listed on Kvation, you agree to comply with and be bound by these Guest Terms, our Terms of Service, Privacy Policy, and other policies referenced herein.

1. Using Kvation as a Guest

1.1 Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use the Services. By accessing or using Kvation, you represent and warrant that you meet these requirements.

1.2 Guest Account

To make a booking, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality and security of your account and for all activities conducted through it.

2. Booking on Kvation

2.1 Booking Process

When you book a Listing, you agree to pay all applicable fees, including the Listing price, service fees, taxes, and any other charges identified at checkout. You also agree to any terms and conditions set by the Host relating to the Listing.

2.2 Guest Responsibilities

As a guest, you agree to:

Follow the Host’s house rules and instructions;
Treat the accommodation and any provided property respectfully;
Avoid causing any damage or nuisance;
Not exceed the maximum number of permitted guests;
Not host parties or events unless expressly permitted by the Host;
Comply with all applicable laws, rules, and regulations.

2.3 Cancellations, Refunds, and Modifications

Your rights to cancel a reservation and receive a refund are subject to the cancellation policy selected by the Host at the time of booking. Kvation’s Guest Refund Policy may apply in certain limited circumstances, such as when a Listing is materially inaccurate or unavailable.

If you wish to modify a booking, it must be agreed to by the Host. Kvation does not guarantee that changes can be made.

3. Fees and Payments

3.1 Payment Authorization

By providing payment information, you authorize Kvation or its payment processor to charge the payment method for the total amount due for the reservation.

3.2 Kvation Service Fee

Kvation charges a service fee for each booking, which helps us operate and improve our platform. The fee is disclosed during the checkout process.

4. Damage to Property

You are responsible for leaving the accommodation and its contents in the condition in which you found them. You agree to report any damage to the Host or Kvation immediately.

If a Host reports damage and provides evidence, you authorize Kvation to charge your payment method or to pursue reimbursement through other means, including collecting via third-party collection agencies.

5. Kvation’s Role

Kvation is not a party to the agreement between you and the Host. We do not own, manage, or control any of the properties listed. Kvation is a limited-purpose agent for processing payments and facilitating communication between Guests and Hosts.

We do not guarantee the existence, safety, or legality of any Listing, nor the performance or conduct of any Host or Guest.

6. Guest Conduct

You agree not to:

Use the Services for any unlawful purpose;
Discriminate against others based on race, religion, gender, national origin, disability, or any other protected status;
Harass, threaten, or harm others;
Circumvent or manipulate our fees or policies;
Use automated means to access the platform.

Kvation may suspend or terminate your account if you violate these Guest Terms or applicable laws.

7. Privacy

Your personal information will be handled in accordance with our Privacy Policy, which explains how we collect, use, and protect your data.

8. Disclaimers

Kvation provides the Services “as is” and disclaims all warranties, express or implied. We do not guarantee the accuracy of Listings, nor the suitability, safety, or legality of any accommodation.

9. Limitation of Liability

To the fullest extent permitted by law, Kvation shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or personal injury, even if advised of the possibility of such damages.

Kvation’s total liability arising from or related to the Services or these Guest Terms shall not exceed the amounts paid by you to Kvation for the booking giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kvation and its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

Your use of the Services;
Your breach of these Guest Terms;
Your interaction with any Host or stay at any Listing;
Your violation of any law or the rights of any third party.

11. Dispute Resolution

11.1 Governing Law

These Guest Terms are governed by and construed under the laws of the State of Nevada, United States, without regard to conflict-of-law principles.

11.2 Arbitration

Any dispute arising out of or relating to these Guest Terms or the Services will be resolved through binding arbitration in Minden, Nevada, except where prohibited by law.

You agree to waive any right to a jury trial or to participate in a class action.

12. Miscellaneous

Entire Agreement: These Guest Terms constitute the entire agreement between you and Kvation.
Severability: If any provision is deemed invalid or unenforceable, the remainder will remain in effect.
No Waiver: Our failure to enforce any right or provision does not constitute a waiver.
Assignment: You may not transfer these Guest Terms without our written consent.
